What the business is
Online health and wellness company that sells telehealth-prescribed products, including compounded GLP-1 weight-loss drugs.
The bet
Hims can sell a compounded oral semaglutide on 'personalization' grounds, at a fraction of Novo's price, before regulators or courts stop it.
How it started
Novo's Wegovy pill won FDA approval in late December 2025 and launched on 5 January at $149 a month for cash-paying patients, a launch seen as critical to regaining ground from Eli Lilly. GLP-1 compounding had begun under federal law during shortages, which have since ended.
What happened
On Thursday 5 February 2026 Hims announced it had launched a compounded version of the Wegovy pill starting at $49 a month, saying it used a different formulation and delivery system than Novo's product. Novo said Hims' version uses liposomal technology instead of its SNAC absorption enhancer and called the launch illegal mass compounding.
How it ended up
On 5 February FDA commissioner Marty Makary wrote on X that the FDA 'will take swift action against companies mass-marketing illegal copycat drugs'. Novo pledged legal and regulatory action and said the FDA had proposed adding liposome drugs to its list of products that cannot be compounded.
What has to be true
Shortages of Novo's and Lilly's GLP-1s had allowed mass compounding under federal law, and compounders now argue 'personalization' to stay within it.
Fierce noted the Wegovy pill was never in shortage, yet Hims priced its version at $49 against Novo's $149 starting cash price.
Hims said its compounded pill used a different formulation and delivery system, which it argued set it apart from the approved product.
What can be applied
Compounders now argue 'personalization' to stay within the law once a shortage ends; a product that a regulator publicly calls illegal copycat is a bet on enforcement timing.
Aftermath
As of 6 February 2026, Hims had not commented, Novo was pledging legal and regulatory action, and the FDA had publicly promised swift action without naming Hims. The FDA's proposed liposome rule was pending.
